Terms of use for Transport for NSW Customer Wi-Fi
By using the Transport for NSW Customer Wi-Fi service (Service), you accept these Terms of use (Terms). If you do not agree to these Terms, please do not use the Service.
The Service is supplied by a service provider appointed by the relevant transport operator.
We may update these Terms and by continuing to use the Service you agree to these changes.
1. Access
- Transport for NSW makes this Free Customer Wi-Fi service available to support your journey. We aim to make this service available wherever possible, but access may vary, and the Service may become temporarily unavailable without notice.
- To ensure fair use for everyone, we may restrict access to the Service if it is used in ways that do not follow the Terms.
- If you are under 18 years of age, please make sure your parent or legal guardian agrees to these Terms and takes responsibility for your use of this Service.
- Once the connection to the Service is established, each device can use this Service for a specific amount of time and within the data limit, as outlined in Schedule A. Once the limit is reached, the connection will terminate until the next day.
- To provide all users a reliable experience, we may manage the bandwidth and limit the number of devices connected at the same time. This helps to maintain basic access for common activities like browsing the internet, checking emails, using social media and trip planning. At busy times, when many users are connected, you might experience slower speeds or may not be able to connect to the Service.
2. Acceptable use
- We apply content filters to the Service, to prevent access to offensive, harmful or inappropriate material and to reduce the risk of security risks. While we aim to maintain a safe environment, we assume no responsibility for any illegal, offensive, indecent or otherwise harmful material accessed through or use of the Service.
- When using the Service, you are responsible for how you use it and the information or data you share, upload, download or communicate. To help everyone have a safe and respectful experience, you must agree to:
- comply with these Terms and all applicable laws
- not infringe our intellectual property rights, or those of any third party
- avoid uploading or sharing any code, virus or data that could harm the systems or devices
- not use the Service in a way that could damage, disable, overload, impair or compromise the Service, systems or security, or interfere with other users of the Service
- not collect or access any information or data that is not intended for you, or attempt to decipher any transmissions
- not share or access content that is defamatory, offensive, otherwise objectionable or likely to cause harm
- not send, receive, publish, post, distribute, transmit, disseminate, encourage or solicit receipt of, upload, download or use any material which is offensive, abusive, defamatory, indecent, obscene, unlawful, harassing or in breach of any other right of any other person
- not use the Service:
- for commercial activity
- to send unwanted messages or spam
- to transmit, store, publish or upload any electronic material which is known or is likely to cause, damage, destroy or limit the functionality of any other person's computer software, hardware or telecommunications equipment
- to invade the privacy of another person, or cause unnecessary annoyance, inconvenience or distress to another person.
3. Security
- You acknowledge that free Wi-Fi Service is an open, public network. While it is convenient for general browsing, it is not designed for sensitive activities like internet banking or sharing personal or confidential information.
- You acknowledge that like any public internet connection, it is never completely private or secure. Your data may be visible to others and the information you send through the Service may be intercepted by another party.
- You are responsible for keeping any usernames, passwords and other security-based login information private and secure while connected.
- We encourage you to take steps to protect yourself and your devices. This includes using up-to-date antivirus software and being mindful of what you click, download or share while connected to this Service.
4. Privacy and information
- When you use the Free Wi-Fi Service, the service provider may collect certain technical information from your device in order to deliver and maintain the Service. This information may include:
- average time users stay connected
- general data usage, and types of websites visited
- the time of day the Service is used
- whether your device has accessed the Service previously
- your device's browser and operating system type.
- While this information is generally used in anonymised or aggregated form, in some circumstances it may be capable of identifying you or your device. The service provider will provide a collection notice that explains how any identifiable data is collected and used.
- By using the Service, you agree that we and our service providers may use this anonymised information to help monitor, maintain and improve the Wi-Fi experience. Anonymised or aggregated information may be shared with other parties involved in managing the Service.
5. Liability
- We aim to keep the Free Wi-Fi Service available and working reliably. However, there may be times when the Service is temporarily unavailable or does not perform as expected. This can happen due to:
- any updates or changes to the Service
- temporary or permanent unavailability of the Service
- slower speeds or interruptions during high usage periods
- limitations in bandwidth or device compatibility
- technical issues affecting your connection, software or hardware
- data loss or exposure to security risks like viruses when online
- To the extent permitted by law and subject to clause 5(c), we are not responsible for or liable for any communications, performance, security or data corruption problems, disconnection of transmission services or failures or delays in transmission of information connected with telecommunication services and other means of transmission provided by third parties.
- To the extent permitted by law, nothing in these Terms limits or excludes our liability for liability that cannot be excluded at law, including death or personal injury resulting from our negligence or fraud or fraudulent misrepresentation.
- You must indemnify and release us from and against any loss incurred or suffered by us relating to or arising from your breach of these Terms, any infringement of a third party's intellectual property or other rights, or your access to or use of the Service.
6. General
- These Terms are governed by the laws of New South Wales which has exclusive jurisdiction over any disputes.
- If any provision of these Terms is found to be unenforceable in any jurisdiction, the remaining provisions of these Terms of use and access will continue in full force and effect.
Schedule A - Usage limit per device per calendar day
- 120 minutes of free internet access per device per calendar day, and
- 500 MB of data per device per calendar day.
